Republic Act No. 8407

On November 23, 1997, Republic Act (R.A.) No. 8407, an Act amending the R.A. No. 6631 entitled "An Act Granting Manila Jockey Club, Inc. a Franchise to Construct, Operate and Maintain a Racetrack for Horse Racing in the City of Manila or Any Place within the Provinces of Bulacan, Cavite or Rizal" was signed into law and granted the company extension of the its franchise for another 25 years from the expiration of the term.

The Act provides, among others, the distribution of the total wager funds or gross receipts, schedule of races and taxes to be paid. Under the Act, the Company shall pay the National Treasury a franchise tax equivalent to 25% of its gross earnings from the horse races in lieu of all taxes, except income tax, that are imposed by the national and local governments on the activities covered by the franchise.

MANILA JOCKEY CLUB, INC.

CLUB RULES AND REGULATION

RULE I- DEFINITION OF TERMS

Section I- unless the context indicates otherwise, the following items shall bear the meaning indicated herein:

a. "Club" or "Racing Club" shall refer to the Manila Jockey Club, Inc. b. "Race Track " shall refer to the San Lazaro Leisure Park. c. "Race Days" shall mean the days on which horse races with betting are allowed by law. d. "Horse Owner", "Trainer", "Jockey", "Apprentice Jockey", Helper", "Groom", Exercise Rider"- the definitions of horse owner, trainer, apprentice jockey, helper, groom and exercise rider under existing rules and regulations of the Philippine racing Commission are hereby adopted under these rules. e. "Stewards", "Cadets Stewards", "Judges", "Starters", "Starting Gate Helper", including the "jockeys Quarters"- as defined under the existing rules and regulations of the Philippine Racing Commission are hereby adopted under these Rules. f. "Racing Public"-shall refers to all inside the premises of the Club and on the racetrack, including those persons in the vicinity of the authorized off-track betting station of the Club.

RULE II- THE MANILA JOCKEY CLUB, INC., GOVERNING BODY, OBJECTIVES

Section I- THE MANILA JOCKEY CLUB, INC.- The Manila Jockey Club, Inc. is a corporation, duly organized and existing under the laws of the Philippines, with principal place business at 14th Floor Strata 100 Bldg., Emerald Ave., Ortigas Complex, Pasig City and engaged in the business of operating a race track, holding horse race at the San Lazaro Leisure Park in Carmona, Cavite with betting both in-course and off-course, pursuant to Republic Act No. 6631, as amended by R.A. 8407.

Section 2- GOVERNING BODY- the Club is governed by a Board of Directors composed of eleven members including a president who is a Chief Executive Officer.

Section 3- OBJECTIVES- The Club is in pursuit of its corporate business, has the following objectives:

a. To promote and protect the interest of the racing public by holding fair and honest races;

b. To make the horse racing industry more responsive for generating revenues for the government, more employment opportunities for the unemployed and providing wholesome entertainment for the public at large;

c. To elevate Philippine horse racing at par with foreign standard, thereby making it an attraction to foreign tourist, in line with the tourism program of the government: d. To foster unity and cooperation among all segments involved in the horse racing industry; e. To provide fair returns to the stockholders for their investments; and f. To formulate rules and regulations governing the conduct and operation of horse racing.

RULE III- REGISTRATION

Section 1 HORSE OWNER- all horse owners shall register with the Club annually, on or before the end of February of each year or as may be determined by the Club. In the event that the last day of February is a non-business day, the registration shall automatically be extended to the next business day. Failure to register within the reglementary period shall constitute sufficient grounds for the automatic exclusion of the horse/s of the defaulting horse owner during race days held at the Club, until compliance herewith is faithfully observed. Each application shall be accompanied by the owner's certificate of registration with the Philippine Racing Commission.

No horse owner can exercise his horse at the racetrack nor participate in horse race held thereat, and/or use any of the Club's facilities unless duly registered with the Club.

The annual registration fee of each horse owner is P100.00, or as maybe amended by the Club from time to time.

Section 2 RACE HORSES- No horse shall be allowed to train in the racetrack of the Club or participate in races held thereat, unless the same is duly registered by its owner or trainer with the Club. Each application for registration of horse shall be accompanied by a copy of the Certificate of Registration as a racehorse with the National Stud Farm or Department of Agriculture, Certificate of Registration with the Philippine Racing Commission, and Certificate of Ownership of Large Cattle.

The registration fee of a horse shall be P50.00 or as may be amended by the Club from time to time.

Section 3 TRANSFER OF OWNERSHIP - Any transfer of ownership must be reported to the Club by the new owner within 72 hours from the date of transfer. For the purpose, a copy of the Deed of sale or a copy of the National Stud Farm Certificate of Registration as racehorse of the horse/s sold, with the sale duly annotated on the said certificate, or a copy of the Transfer Certificate of Ownership of Large Cattle, must be submitted to the Club.

Failure to comply with these rules shall constitute sufficient grounds for the exclusion of the horse/s concerned in horse race held at the Club, until compliance herewith is faithfully observed. Each application shall be accompanied by horse trainer's certificate of registration with the Philippine Racing Commission.

No horse trainer can exercise his profession of training horses at the race track of the Club during training days, nor run his horses therein during race days unless duly registered with the Club.

The annual registration fee of each horse trainer is P50.00 or as may be amended by the Club from time to time.

Section 5 TRANSFER OF TRAINERSHIP any transfer of trainership must be reported to the Club by the new trainer, duly attested by the horse owner concerned within 72 hours from the date of the transfer of trainership of said horse. Failure to comply with this rule shall constitute sufficient grounds for the automatic exclusion of the horse/s involved in the transfer, in all horse races held at the Club, as well as the use of its facilities, until compliance herewith is faithfully observed.

Section 6 JOCKEYS- all jockeys shall register with the Club annually on or before the end of February of each year, or as may be determined by the Club. In the event that the last day of February is non- business day, the registration shall automatically be extended to the next business day. Failure to register within the reglamentary period shall constitute sufficient grounds for the automatic exclusion of the defaulting jockey in all horse races at the Club, until compliance is faithfully observed. Each application shall be accompanied by the jockeys Certificate of Registration with the Philippine Racing Commission.

No jockey, professional and /or apprentice, shall be allowed to exercise his profession at the Club during training days, nor during race days unless duly registered with the Club.

The annual registration fee of a jockey is P50.00 or as may be amended by the Club from time to time.

Section 7 EXERCISE RIDER- No exercise rider shall be allowed to exercise horses at the Club, unless duly registered with the Club. All exercise riders shall register annually, until issued a license as a jockey by the Philippine Racing Commission, in which case he shall register under section 6 hereof.

Failure to comply with these rules shall constitute sufficient grounds for the automatic exclusion from exercising horses at the Club, until compliance herewith is faithfully observed.

The annual registration fee of a jockey is P20.00 or as may be amended by the Club from time to time.

Section 8 JOCKEY'S HELPER- a jockey is allowed to have one helper only. The helper must be of legal age and must be duly registered with the Club and with the Philippine Racing Commission.

Jockeys shall register their helpers annually with the Club, on or before the end of February of each year or as may be determined by the Club. In the event that the last day of February is a non-business day, the registration shall automatically be extended to the next business day. Failure to comply with these rules shall constitute sufficient grounds for the automatic exclusion of the non-registered helper from performing his duties during race days held at the Club.

The annual registration fee of a helper is P10.00 or as may be amended by the Club form time to time.

Section 9- GROOMS- Horse trainers shall their respective grooms with the Club, otherwise, the non- registered grooms shall not be allowed to perform their duties within the premises of the Club.

Grooms shall only be allowed the following areas:

a. In the Saddling paddock, while their horses are quartered therein; b. In the track, while leading their horses from their respective stables or the waiting shed to the saddling paddock, or from the saddling paddock up to the portion of track fronting the steward's stand during the parade of their horses towards the starting gate; and c. In the Grooms' waiting area, while waiting the termination of their horse's race, which is in progress. Horse trainers shall likewise provide their grooms the proper and decent uniforms and shoes, otherwise, the grooms with improper attire shall not be allowed to perform their duties during race days held at the Club.

The annual registration fee of a groom is P10.00 or as may be amended by the Club from time to time.

Section 10- COMMISSION REGISTRATION AND/OR LICENSE

Notwithstanding compliance with these rules on registration, horse owners, trainers, jockeys, exercise riders, helpers and grooms shall not be allowed to exercise their respective profession within the Club premises during training days, and race days held thereat, unless they are duly registered and/or licensed by the Philippine Racing Commission.

RULE IV- POWERS AND FUNCTIONS

Section I- BOARD OF STEWARDS- The Club shall act through the Board of Stewards who shall have over-all supervision and control over the conduct of races during racing days.

The Board of Stewards shall be composed of a Chairman and at least two (2) members, to be appointed by the Club's Board of Directors/ President, and shall be licensed, as such by the Philippine Racing Commission. The compensation of the Board of Stewards shall be for the account of the Club. In case of incapacity of the Chairman and/or any member during a particular racing day, the CLUB shall designate any or all the Cadet Stewards to fill up the vacancy.

The Board of Stewards shall fully and strictly implement the Racing Rules under its power and duties. Any penalty imposed on horse or erring jockeys or trainers or horse owners, particularly any violation or infraction of the rules resulting in any disqualification, the Board of Stewards shall cause the announcement and explanation thru the Public Address System. The Club may from time to time rotate assignments of the Stewards.

Section 2 CADET STEWARDS- The Club shall appoint at least two (2) CADET Stewards, and shall be licensed as such by the Philippine Racing Commission. The Cadet Stewards shall perform their duties and responsibilities as enumerated in the Philracom's Racing Rules

Section 3 BOARD OF JUDGES- the Club shall have a Board of Judges to be composed of a Chairman, and at least two (2) members, and shall perform the duties and responsibilities as enumerated in the Philracom's Racing Rules.

Section 4 STARTING GATE HELPERS- The Club shall have at least fourteen (14) starting gate helpers, duly registered with the Philracom, and shall perform their duties and responsibilities in accordance with the Philracom's Racing Rules.

The Starting Gate Helpers shall strictly observe the following rules and procedures:

a. Before the start of the first race during a racing day, the Racing Manager or his duly designated Assistant shall conduct a drawing of numbers for the starting gate helpers for their respective assignment of Stalls. b. Starting Gate Helpers with assigned stalls are prohibited from assisting other entries, other than the entry in his assigned stall unless authorized by the Board of Stewards upon recommendation of the Starter. c. Depending on the numbers of entries participating in a particular race, only the starting gate helpers assigned to the stalls to be occupied are allowed at the starting gate post area. d. Starting gate helpers without duty I a particular race shall confine themselves in the area (at the training track) designated by and within the view of the Stewards. They will be joined by the starting gate helpers on the duty after the start of each race. e. Any request for additional starting gate helpers to assist in the loading of an entry or entries, the starter shall be confined in the designated area between races, and shall only be allowed to leave upon permission by the stewards. f. I'm opinion of the Starters and /or the Stewards, an entry or entries needs additional assistance, the Stewards may assign additional starting gate helper even without any request, so as to effect smooth loading of the entry in the stall. g. Entry or entries which are guided or led by its groom during the parade leading the starting gate, the groom shall only be allowed up to a certain point, after which the groom shall turn over the horse to the assigned starting gate helper up to the starting post. For this purpose, the starting gate helper assigned to such stall to be occupied by said horse shall be the only one to take over the handling of the horse from the groom, upon instruction by the starter and/or the Stewards. The turnover point. h. Starting gate helpers are prohibited from communicating with unauthorized persons verbally or otherwise. They shall be confined in the designated area between races and shall only be allowed to leave upon permission by the stewards. i. Any violation of this provision, the Starting Gate Helpers shall be penalized as follows:

a. First Offense- written warning b. Second Offense- 1 racing week c. Third Offense- 2 racing weeks d. Fourth Offense- Termination for cause

Section 5 JOCKEY'S HELPERS- (As defined under the Philracom Racing Rules)

A jockey shall be allowed to register with the Club only one helper. Any additional helper allowed by the Philracom shall be communicated with the Board of Stewards, upon approval, shall be issued by the Club temporary Access card, valid only on that particular race day. The jockey's helpers shall be allowed only in the areas designated by the Club. They shall not be allowed to leave the designated areas until his jockeys has finished his last ride for the day, and both shall leave the racetrack without delay. In cases of emergency, the helper maybe allowed to leave the designated areas only with the permission with the Board of Stewards. Any violation of this Rule, the jockey concerned shall be penalized with two (2) racing week suspension, and the registration with the Club of the helper concerned shall be revoked.

Section 6 GROOMS- As defined by the Racing Rules

A horse who enters the racetrack during race days with more than two (2) grooms, the horse concerned shall be suspended for one (1) racing week.

Section 7 BETTING PUBLIC- a person who enters the Club premises during race days shall be bound by the duly approved Club Rules. For purpose of this provision, the betting public shall (in addition to the regular racing public or patrons) include the stockholder) horse owner, trainer, jockey, jockey's helper, horses' grooms and other licensee and employees of the GAB and Philracom.

The betting public shall strictly observe the following rules:

a. No person shall be allowed to bring inside the premises of the racetrack firearms, cellular phones and other communication equipment (Philracom Racing Rules). b. Policemen, military personnel, whether in uniform or in plain clothes, shall be allowed to carry firearms while inside the premises of the racetrack, only while on duty, and only upon presentation of a valid assignment order or mission order, otherwise, the firearms shall be deposited with the Club's Security Force office (Philracom Racing Rules). c. Cellular Phone or other communication equipment shall be deposited at the gate entrance gate of the Club, and will be duly receipted. The equipment will only be released to the owner or holder of the receipt upon exit and presentation of the receipt. d. Persons who are unruly or intoxicated shall be ruled-off the premises of the Club. e. Persons who are suspected of arranging, offering or taking bets such as illegal bookies, shall be apprehended and removed from the premises of the Club. f. Person who are suspected of arranging or offering money are taking money for purposes of fixing a race, shall be apprehended and removed from the premises. g. Persons who are caught arranging, offering or taking illegal bets, shall be apprehended and turned over to the police authorities. The persons apprehended shall be photographed, and banned from entering the premises of the Club in future racing days, or non-race days, without prejudice to whatever other legal remedies the Club may impose.

Section 8 CENTER GATE- This gate shall be the only gate to be used during racing day, for entry leading to the race track by the horse owners or trainers with horses participating in a race, as well as jockeys with rides and their jockeys helpers, for purposes of weighing-out and in going to the jockeys quarter, including other authorized persons. The guard on duty shall strictly observe the policy on the use of this gate.

Section 9 ADDITIONAL STARTING GATE HELPERS - In case a horse or horses participating in the races shall need the assistance of an additional starting gate helpers in the loading of such horse/s in the respective stalls, the owner or trainer or authorized representatives shall make the necessary request with the Stewards for such assistance before the first race of a particular racing day.

Section 10 PENALTIES- Any violation of these Club Rules not covered by corresponding penalties, the Board of Stewards and/or the management of the Club, may at its sole discretion, impose a penalty on the erring party, or impose additional penalty depending on the gravity of the violation, subject to the appeals as provided for under this rules.

Section 11 MJCI SECURITY FORCE - It shall be the duty and responsibility of the Club's Security Force to enforce and/or assist all Club personnel, in the implementation of the Club rules, including all other duties, which the Club management may from time to time assign.

RULE V- TRAINING DAYS AND HOURS

Section 1 TRAINING ATTIRE- all jockeys and exercise riders must wear crash helmets, sleeved shirt, riding pants and shoes, preferably riding boots during training days.

Section 2 SCHEDULES

a. Venue Days Time 1.Traning Track (daily) 5:00 a.m. to 8:00 a.m. 2. Main Track (daily) 8:01 a.m. to 10:00 a.m.

b. The training track may still be used during the use of the main track; however, racehorses intending to use the training track must use the underpass in going in and/or out of the training track.

c. During weekend (Saturday/Sunday) and whole day races at MJCI, the schedule of rehearsals shall be as follows:

a. Venue Days Time 1.Traning Track (daily) 5:00 a.m. to 7:00 a.m. 2. Main Track (daily) 7:01 a.m. to 8:30 a.m.

d. Use of Starting Gate Days Time Starting Gate Tue/Thursday 8:00 a.m. to 10:00 a.m.

Unless otherwise prescribed by the Club, the starting gate shall be available to all horse owners, trainers, and jockeys every Tuesdays and Thursday from 7:00 a.m. to 10:00 a.m.

All horse owners and trainers who may wish to use the starting gate other than the regular schedule, shall secure from the authorized officials of the Club a permit, at least one day before the scheduled date.

Unless otherwise prescribed by the Club, the stationary (fixed) starting gate shall be available to all horse owners, trainers and jockeys for the training of new horses or vicious horse, from Monday to Friday 9:00 a.m. to 11:00 a.m.

e. Schedule of vicious and Novato horses The trainers and jockeys of vicious and novato horses must schedule the training of their vicious and/ or novato horses late in the regular schedule workouts, that is from 9:00 a.m. to 10:00 a.m. on regular days, and/or from 7:30 a.m. to 8; 30 a.m. only during whole day races at MJCI. Vicious and navato must stay in longer that straight ten (10) minutes at the gate, otherwise, they must give way to the other waiting racehorses, and soon as the other racehorses have finished their turn, then the uncontrollable vicious and navato horses maybe train again at the starting gate.

Section 3 PASSAGEWAYS

a. During the use of the main track, all horses that will use the training track must use the underpass, otherwise, the gates at 1400 meters and/or 800 meters marker shall be used for entry to the training track. Accordingly, all racehorses going out of the training track must use the gate at 1800 meters and 2025-meter marker. b. Absolutely, no warm down will be allowed after a fast workout ("trangko") and/or canter. c. All horses which just came out of the training track must use the outer rail of the main track in going to the exit gates at Tayabas and/or Consuelo. d. No counter flow will be allowed, and all racehorses intending to exit from the training track, and which overshoots the nearest exit gate of the training track, must proceed all the way to the next exit gate.

Section 4 TYPE OF WORKOUTS ACCORDING TO THE TRACK BEING USE.

a. Main track will be used strictly for fast workouts (trangko) and fast canter (at least 35 seconds per quarter) only. b. Training track will be strictly for trotting (torote) and slow canter only.

Section 5 PENALTIES

a. The registered trainer and rider of the erring racehorse, after being found guilty for violation of any provision of this rules and regulations, shall be penalized as follows:

First Offense P 100.00 each Second Offense 500.00 each Third Offense 1,000.00 each or suspension of one week

Thereafter, any further violations shall mean the imposition of the double amount of the latest fine or number of days of the latest suspension.

Non payment of fine and/or service of suspension shall bar the trainer and rider of the erring horse from using the training track, main track, starting gate and other training facilities of MJCI, for horses under his responsibility.

Fines shall be payable to the MJCI, and violators will not be allowed to declare and/ or participate in MJCI races, unless and until the penalties have been paid and/or serve.

RULE VI- SADDLING PADDOCK

Section 1- SADDLING PADDOCK- The Saddling Paddock is the enclosure where all participating entries during race day held at the Club be kept two races before their scheduled race.

Section 2- PADDOCK STEWARD - The Paddock Steward shall be the Officer-In-Charge of the Saddling Paddock Area which includes Saddling Paddock, Stewards stand, Paddock Steward's Office, Jockeys & Groom Waiting Area, Parade Ring and Drug Testing Area. He shall have under his direct supervision the Club Veterinarian and the Farrier assigned thereat. He shall be responsible for the enforcement of all rules governing the Saddling Paddock, and shall report to the Board of Stewards any violations of said rules or irregularities that may be committed in the Paddock together with his recommendations.

Section 3- CLUB VETERINARIAN- The Club shall assign a Veterinarian in the Saddling Paddock Area, who shall be under the supervision of the Paddock Steward, and who shall inspect the horses in the paddock, prior to the race, in order to determine their soundness or fitness to participate in said race, as well as the Starting Gate, immediately informing the Board of Stewards and/or the Starter, through the Paddock Steward, of any unsound or unfit horses.

He will render immediate assistance during an emergency to a race horse in distress, either in the saddling paddock or on the race track, and perform other duties as may be required by the Philippine Racing Commission or the Club.

Section 4- FARRIER OF BLACKSMITH- the club shall assign to thew saddling paddock a farrier or blacksmith, who shall be duly registered with the Philippine Racing Commission. He shall be present at the saddling paddock during racing days, for the purpose of rendering proper and immediate assistance to horses requiring simple remedial attention. He shall likewise inspect the horseshoes of the entries, and perform the duties enumerated under Chapter III, Sec. 24 of the Philippine Racing Commission rules and regulations. At the end of a racing day, the Farrier shall accomplish a report from to be submitted to the Paddock Steward.

Section 5- SADDLING PADDOCK PROCEDURES- the following procedures shall be observed at the saddling paddock:

a. Entries participating in Races 1& 2 shall be at the saddling Paddock thirty minutes (30) before the scheduled post time of the race No. 1, as indicated in the days racing program. b. Entries participating in Race 3 shall be at the Saddling Paddock immediately after Race 1 is held, and so on until the last race of the day. c. Upon the sound of the bugle call, horses inside the Saddling Paddock, shall be brought to that Inner Paddock or Walking Ring not later than ten minutes before the post time of their scheduled race, wherein they shall be saddled by their respective trainers or jockeys. d. Each entry is entitled to be accompanied by not more than two grooms, who must be properly attired, identified (with MJCI ID) and registered with the Club, and who shall be strictly prohibited from smoking while leading the horses. e. Jockey's Helpers shall be allowed to enter the Saddling Paddock only while assisting his jockey, and shall immediately proceed go the groom's waiting area after his jockey has mounted. f. Grooms accompanying participating horses at the Saddling Paddock are prohibited form communicating with anyone, except the paddock steward veterinarian, the farrier, the owner, trainer, jockey and jockey's helper of the horse concerned, as well as authorized officials of the Philippine racing commission and the Club. g. Horse owners and trainers of the horses quartered at the saddling paddock or Inner paddock, shall be allowed to enter the area, provided that their wear their identification cards issued by the Club. h. Upon the sounding of the parade call from the Board of stewards through the public address system, participating entries shall be led out of the inner paddock in their numerical order, and with their respective jockeys mounted.

Entries in the navato races or Barrier Trial races or races for vicious horses, shall be brought into and out of the saddling paddock at such times and under such procedures, as shall be announced by the Club from time to time thru the Board of Stewards.

Section 6- PENELTIES- the following penalties shall be imposed:

a. For violation of Sec. 5 subparagraph a and b, the horses arriving late shall be suspended for one (1) racing week; b. For violation of Sec. 5 subparagraph c and d, the horse shall be suspended for one (1) racing week, and their trainer is subject to a fine of P100.00. c. Anyone found administering drugs, either oral or injectables, shall be banned from the premises of the Club, in addition, if the violator is a license of the Philippine Racing Commission, the violation shall be subject to the existing Rules and Regulations of the Philippine Racing commission. d. Horse owners or trainers entering the Saddling Paddock or Inner Paddock, wherein there is no entry owned or trained by him, shall be banned from the premises of the Club and all horses under his ownership or trainership, shall not be accepted in future races of the Club, notwithstanding and subsequent transfer of ownership or trainership of the horse/s concerned for a period of six (6) months; e. A jockey entering the Saddling Paddock or Inner Paddock wherein there is no entry to be ridden by him, shall be suspended for a period of six months. f. A jockey shall be allowed to enter the Saddling Paddock wherein there is no entry to be ridden by him in the immediately succeeding scheduled race.

RULE VII- JOCKEYS' QUARTERS

Section 1- JOCKEYS' QUARTER, CLEANLINESS, and REORTING TO, ETC.

The Club shall maintain a jockey's quarter in accordance with the Philippine Racing Commission rules, where jockeys shall be quartered at least 2 races before their scheduled ride, and shall not be allowed to leave unless the Jockey is about to ride in the immediately succeeding scheduled race.

Jockeys inside these quarters shall be under strict obligation to keep the premises clean, and to refrain from using the facilities therein in a reckless or destructive manner. Violation hereof shall be fined by at least P500.00.

A jockey who has finished his ride and who will have another ride later in the day may leave the quarters, provided he comes back at least two races before his later ride. Violation hereof shall be penalized by suspension of five (5) racing weeks.

Jockey or jockeys' helper or any other person shall not be allowed to bring inside the premises of the jockey's quarter, including the anteroom, or other areas within the enclosures or building, firearms, cellular phones and other communication equipment. Violation hereof shall be:

1st offense- 1-year suspension 2nd offense- revocation of Club registration and banned from the premises of the Club.

Section 2- ANTEROOM- the jockey's quarters shall have an anteroom where the jockeys' helpers shall stay. Jockey's helpers shall not enter the jockeys' quarters beyond the anteroom. Violation hereof shall be penalized by the suspension for two (2) racing weeks of the jockeys concerned.

Jockeys' helper shall be entitled to stay in the quarters' anteroom only, while their respective jockey-employers are quartered in the jockeys' quarter. Violation hereof shall be penalized by the revocation of the helper's Club registration (permit).

RULE VIII- FEATURED BETS

Section 1- PARI MUTUEL, DAILY DOUBLE, ETRA DOUBLE, FORECAST, TRIFECTA, QUARTET, WINNER-TAKE-ALL, DOUBLE QUINELLA, PICK-6, PENTAFECTA, SUPERFECTA, DOUBLE-FORECAST, TRIPLE-TRIFECTA, JACKPOT 9- The definitions, rules and regulations, including its amendments of Pari-Mutuel, Daily-Double, Extra-Double, Forecast, Double Quinella, Trifecta, Quartet, Pick-6, Winner take All, Pentafecta, Superfecta, Double Forecast, Triple-Trifecta, and Jackpot 9 featured bets approved by the Philippine Racing Commission and/or Games and Amusements Board are hereby adopted.

Subject to the approval of the Philippine Racing Commission and/or the Games and Amusements Board, the Club may introduce other forms of featured bets.

RUEL IX- CLUB NOVATO RACES AND THE "1867 FOUNDERS' CUP"

Section 1- The Club may hold the Club Novato races and the "1867 Founders Cup Stakes on the date and time to be designated by the Club, subject to the approval of the Commission.

Section 2- CLUB NOVATO RACES

a. Distance- the Club Novato races shall be run over a distance of 1425 meters. b. Eligibility of Entries- A horse to be eligible in the Club Novato races must fulfill the following requirements;

1.Must be a novato horse as defined by the Philracom's rule and regulations.

2.Must be a native or born in the Philippines, duly branded in such form that can be clearly identified, and for which the owner shall submit a certificate of ownership, officially registered with the National Stud Farm Department of Agriculture, and the Philippine Racing Commission.

3. Must at least two (2) years as per the certificate issued by the National Stud Farm or Department of Agriculture.

4. Must have passed the Starting Gate Schooling, as duly certified by the licensed Club Starter.

5. Must be duly registered with the Club.

c. Inscription

1. The owner or trainer of a racehorse duly registered with the club must file his application for inscription on the days designated by the Club. 2. Upon presentation of the application, an inscription fee of p5.00 shall be paid.

d. Declaration Entries:

Once accepted, declaration shall be made in the prescribed from upon payment of the declaration fee of P 500.00 per horse on the days designated by the Club.

e. There shall be a minimum of one (1) declared horse in order that the Novato race shall be run.

Section 3 - "1867 FOUNDERS CUP"

a. Date of Races:

The "1867 Founders' Cup" race shall be held annually during the month of May, with the first "1867 Founder's Cup" to be held in May 1977.

b. Distance of race: The distance of the "1867 Founders' Cup" race shall be 1900 (1-3/16 mile)

c. Eligibility of Entries: Open to all horses which have participated in a race or as may be determined by the Club from time to time.

d. Application for registration

1. The owner or trainer of a racing horse which is eligible in accordance with Sec. C shall file his application to participate in the "1967 Founders' cup race on or before 21st day before the scheduled race, or as may be determined by the Club. 2. Together with the application for registration, the owner or trainer shall pay the corresponding registration fee.

e. Declaration of Entries:

1. Declaration of entries must be submitted eleven (11) days before the scheduled race, from 9:00 a.m. to 4:00 p.m. or such day and time as the Club may designate. 2. The declaration must be made in the prescribed form of the Club, and shall be accompanied by the corresponding declaration fee. f. Elimination's:

In the event that more than fourteen (14) entries are declared, the elimination procedure the Philracom's Rules and Regulation are hereby adopted in our Rules. g. Handicap Weight:

The handicap weight of the finally declared and qualified entries shall be Open Handicapping, as may be approved by the Club's Committee on handicapping.

h. Prizes and Cup:

1. The Club shall announce the amount of the prizes and awards for a particular year, prior to the date of registration of entries participating in the "1867 Founders Cup" Stakes race. 2. A replica of the "1867 Founders Cup" shall be awarded to the owner, and trophies or plaques to the trainer, and jockey of the first place winning horse.

i. Minimum entries;

There shall be a minimum of eight (8) declared entries so that the "1867 Founders Cup shall be held, provided that the Club may at its sole discretion decide to hold the "1867 Founders' Cup" despite having less than eight finally declared entries.

Section 4- GENERAL PROVISIONS

a. No refund of any fee paid in accordance with these rule shall be allowed, except under the following conditions:

1. Registration fee (inscription) of horses inscribed but eliminated under Section 3 (f) hereof. 2. Inscription and declaration fees paid for races, which are cancelled.

b. Subject to the approval of the Philippine Racing Commission, the Club may adopt such additional Rules and regulations, as it may deem necessary.

RULE X-MISCELLANOUS PROVISION

Section 1 ADOPTION OF COMMISSION AND GAB RULES

In addition to these rules, the Club hereby adopts the rules and regulations of the Philippine Racing Commission and the Games and Amusements Board, as integral parts hereof, including the imposition of the penalties thereof.

Section 2 APPEALS ON THE DECISION OF THE BOARD OF STEWARDS OR ANY OTHER COMMITTEE CREATED BY MJCI

Decision of the Board of Stewards, on question of facts and laws, maybe appealed to the Committee on Appeals by the person(s) directly affected and aggrieved by it.

Six copies of the notarized and typewritten appeal, indicating thereat the reasons and ground relied upon and supporting document, if any, address and/ or telephone number of the appellant, must be filed at the Office of the Chief Operating Officer within seventy hours from receipt of the decision of the Board of Stewards together with the official receipt of the appeal fee of P250.00 issued by the general Cashier, MJCI.

All appeals on decisions declared by the Board of Stewards, filed in prescribed form and within the reglamentary period, and the corresponding appeal fee of P250.00 duly paid, shall set for hearing by the Committee on Appeals every Thursday immediately after the racing week of MJCI at 2:00 p.m., unless for compelling reason hearing was set on other days.

The Committee on Appeals, shall resolved all appeals within fifteen days from receipt thereof, unless the appellant unilaterally requested for additional time to submit additional proof to support his claim.

The other committees which maybe created by the management may resolved all appeal on questions not within the jurisdiction of the Committee on Appeals on the manner previously prescribed.

Section 3-PROPRIETARY RIGHTS- notwithstanding the provisions of the herein Rules, the Club may, in the exercise of its Proprietary Rights, discipline, rule-off, ban or exclude from the premises of the Club, any person or persons; if in the opinion of the Club, such person or persons committees act or acts which are inimical to the interest of the Club, including but not limited to person or persons who are suspended, rule-off, banned or has been excluded from the premises of other racing Clubs.

Section 4- AMENDMENTS, ETC.- the club may amend, modify or repeal, or add to these rules and regulations, or any portion hereof whenever necessary for approval of the Philippine racing Commission. Section 5 -PRIORITY- the rule promulgated by the Philippine Racing commission shall prevail in case there is a conflict with any provisions of these rules.

Section 6 EFFECTIVITY- these rules and regulation shall take effect upon approval by the Philippine Racing Commission.
